Terms and Conditions for El Deste

Welcome to El Deste ("we," "us," or "our"). These Terms and Conditions govern your use of our website and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. This includes a unique username and a valid email address. You must agree to these Terms and Conditions during registration. Failure to provide accurate information or adhere to these terms constitutes a breach, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

2. User-Generated Content and Responsibility

Our Service allows you to upload and store audio files ("User Content"). You are solely responsible for the User Content that you upload to the Service, including its legality, reliability, and appropriateness. You warrant that you own or have the necessary rights to the content you upload and that it does not infringe on any third-party rights.

We do not claim ownership of your User Content. However, by uploading content, you grant us a license to host, display, and serve that content as part of the Service's functionality (e.g., in the "Discover" section). We reserve the right to remove any User Content that violates our policies or the law.

3. Account Tiers and Limitations

El Deste offers different account tiers with varying features and limitations:

• User (Standard Account): Upon registration, you are granted a standard User account. These accounts are limited to a maximum of four (4) buttons and ten (10) sounds per button. The maximum file size for each uploaded audio file is 3MB.
• Super-user: Users can upgrade to a Super-user account by entering a valid upgrade code, which can be obtained from an administrator. Super-user accounts have increased limits, allowing up to one hundred (100) buttons and one hundred (100) sounds per button. The 3MB file size limit still applies.
• Administrator: These accounts are for site management and have no functional limitations on buttons or sounds.

These limits are subject to change. We reserve the right to modify account tiers and limitations in the future.

4. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including a breach of these Terms. This right extends to the full deletion of your account and all associated User Content (uploaded files and board layouts) at the discretion of a site administrator.

Upon termination, your right to use the Service will immediately cease. You can request account deletion by contacting an administrator, which will result in the permanent removal of all your data from our servers.

5. Limitation of Liability

In no event shall El Deste be liable for any indirect, incidental, special, consequential or punitive damages, including loss of data, resulting from your use of the Service or the content therein.

6. Changes to Terms

We reserve the right to modify or replace these Terms at any time. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms.
